A WhatsApp assistant can organise incoming questions and prepare useful replies. That does not mean it can message everyone whose number appears in a spreadsheet. For a UAE business, the safe design question is not simply “Can this software send?” It is “Why is this person receiving this message, what permission and rules apply, and who approves it?”
This guide separates three things that are often muddled: the customer's current request, WhatsApp's product policies and UAE legal obligations. It is general operational guidance, not legal advice or an assurance that a particular campaign is lawful. Review your activity with the relevant authority or a qualified adviser before launch.
Start by naming the purpose
An incoming question about an appointment is a service request. A reminder about that requested appointment has a different purpose from a promotion for another service. An assistant should not silently turn the first into permission for the second.
Write the purpose into the workflow: answer this enquiry, collect this booking request, or prepare this specific update. Keep unrelated promotional activity out of the initial pilot. If the proposed business case depends on importing purchased numbers and sending a sequence, it is not the inbound-first workflow WH Digital recommends.
A useful message record includes the request source, date, purpose, relevant permission and current status. Staff should be able to explain why a draft exists without asking a model to reconstruct the justification after the event.
UAE telemarketing rules extend beyond voice calls
The official Cabinet Resolution No. 56 of 2024 page identifies the telemarketing regulations and their effective date. The resolution's definitions include marketing messages through social-media applications. It should not be dismissed as relevant only to a person making traditional phone calls.
The text includes obligations concerning approval from the competent authority, local company-registered numbers, a channel for interested consumers, the Do Not Call Registry, records and other controls. Which obligations apply to your precise message and implementation needs proper assessment. Consent is important, but “we have consent” is not a complete compliance programme.
Free-zone status is not a general escape hatch. The DIFC Registrar's guidance explains the broad scope, including companies in financial free zones. That guidance is useful context, but do not present DIFC-specific data-protection rules as the rules for every UAE entity.
WhatsApp has a separate permission requirement
The WhatsApp Business Messaging Policy, checked for this draft, says businesses may contact people only when they have provided their number or username and the business has received opt-in permission for subsequent messages or calls. It also requires businesses to respect requests to stop or opt out, including requests made outside WhatsApp.
Being able to see a number on a website is not the same as that permission. Nor should a marketing checkbox be hidden inside an unrelated action. Explain the business identity and the types of messages someone is choosing to receive, and preserve evidence of the choice.
Do not treat an old customer list as automatically reusable for every new campaign. Check the original purpose, permissions, current suppression status and any applicable legal requirements. A person replying to an operational question may still not want promotions.
The 24-hour window is not a legal permission slip
For the WhatsApp Business Platform, the policy allows replies without a message template within the 24-hour customer-service window, which opens and resets with a user's message. Outside that window, approved message templates are required. These Platform-specific rules should not be carelessly described as identical features of every WhatsApp product.
Template approval concerns the platform's review of a template. It does not prove that a recipient opted in, that local marketing obligations are met or that sensitive content can be included. Likewise, an open customer-service window does not remove privacy, content or sector restrictions.
Build the distinction into the draft queue. If the required window or template conditions are not met, stop and flag the item. Do not ask a model to find a way around a platform restriction.
Human escalation belongs in the first version
The same WhatsApp policy says automated responses must have prompt, clear and direct escalation paths. A customer should not have to repeat “human” indefinitely while a bot keeps answering.
For a draft-first workflow, a staff member already reviews outward messages. Still, define where requests for help go, who checks the queue and what customers are told outside operating hours. Do not claim round-the-clock human support if nobody is assigned to provide it.
Complaints, uncertainty, requests involving sensitive records and permission disputes should be routed for review. The assistant's job is to preserve context and make the issue visible, not argue with a customer or decide whether their opt-out counts.
Suppression must work across the workflow
A stop request needs to affect more than one conversation. If an assistant suppresses a contact in the inbox but another scheduled workflow still prepares a campaign, the system is not behaving as intended.
Maintain a minimal, controlled suppression mechanism, with access and retention reviewed for your circumstances. Record the scope of the request and prevent inappropriate future contact. Avoid importing a deleted marketing list again and recreating the same problem.
Test clear and indirect refusals, Arabic and English wording, duplicate records and requests received by email rather than WhatsApp. A person should not need to use a specific magic word to have their wishes recognised and reviewed.
Protect the content as well as the contact list
WhatsApp's policy also addresses permissions, privacy notices and sensitive information. The UAE government's data-protection overview describes broader personal-data obligations and cross-border controls. Know where your inbox provider, integration and model process message content.
Use synthetic data for a demonstration. Do not paste identity documents, payment details or patient information into an unreviewed tool. For regulated sectors, the ordinary business-chat design may be inappropriate even when the customer initiated the conversation.
A practical starting checklist
Before a pilot, confirm the message purpose, permissions, business identity, data flow, human owner, escalation route, suppression behaviour and manual fallback. Keep it draft-only until the team can explain and test these controls. Do not add cold WhatsApp, SMS or calls as an “extra channel.”
The 2,500 AED AI Ops Audit maps a practical workflow and its boundaries; it does not certify legal compliance. The free three-question check can suggest a lower-risk starting task without collecting your contacts. Good automation should make your rules easier to follow, not make it easier to contact people who never asked to hear from you.
The AI Ops Audit is a 2,500 AED review of your workflow, with a prioritised plan. No guaranteed outcomes. Implementation is separate.
